That on or about the 26th day of December, 1928, I was in charge of the records and files of the office of the Clerk of the District Court, due to the fact that Anna B. Smith, Clerk of the District Court was absent from Sheridan County, on that date and that I was acting in my official capacity as Deputy Clerk of the District Court. That upon the date above stated, one C. A. That such files were never returned to the office of the Clerk of Court after that date and although diligent and thorough search has been made both in the office of the Clerk of Court and in the office of the Judge of the District Court, no trace of said files can be found.
