Book B of Wills, Page 353• Testator first directs the payment of all just debts and expenses of last sickness. SECOND: I give, devise and bequeath all my property, real, personal and mixed, of whatsoever kind or character the same may be or wheresoever situate, of which I may die possessed, or to which I may be entitled, to my son Louis J. Paul, my daughter Elizabeth Meyer and my daughter -in -law Mary Carr, all of Sheridan, Wyoming, share and share alike. Nominates and appoints his said son, Louis J. Paul Executor of this last Will, to act without bond. George Paul signs by his mark in the presence of two wit- nesses. Petition for probate of will filed Dec. 19, 1931. Petitioner, Louis J. Paul, alleges: That George Paul died on or about the 10th day of December, 1931, at Sheridan,Wyoming. That said deceased at time of his death was a resident of the County of Sheridan, Wyoming and left estate therein consisting of real and personal property. That said deceased left a Will bearing date Dec. 4, 1931, which your petitioner alleges to be the last will and testament of said deceased, and which is herewith presented. That Louis J. Paul is named in said Will as Executor thereof, and Louis J. Paul, a son, Elizabeth Meyer a daughter, and Mary Carr, a daughter -in -law, all over the age of 21 years are named therein as devisees. That the next of kin and heirs at law of said testator are Elizabeth Meyer, a daughter, Louis J. Paul, a son, and Melvin Paul, a grandson, all over the age of 21 years. Prays that said will be admitted to Probate, and that Letters Testamentary be issued to your petitioner and that a time be appointed for proving the Will. Order entered fixing ti;;ie for proving the Will Dec. 19, 1931. Jan. 12, 1932 at 10 o'clock a. m. set as the time for proving the Will. Notice of Hearing on Petition for Probate of Will published in the Sheridan Press, a newspaper of general circulation, published at Sheridan, Sheridan County, Wyoming, four times as follows: Dec. 21, 28, Jan. 4, 11, 1931. Proof of Publication filed Jan. 12, 1932• Proof of Mailing Notices to Heirs filed Jan. 12, 1932. Order Admitting Will to probate entered Jan. 12, 1932. The Court finds that the document heretofore filed purporting to be the last will and testament of George Paul, deceased, is the Last Will and testament of said deceased, that it was executed in all parti- culars as required by law, and that said testator died on the 10th day of Dec. 1931, a resident of the County of Sheridan, State of Wyoming at the time of his death. It is Ordered that said document heretofore filed purporting to be the last will and testament of said George Paul, deceased, be admitted to probate as the last Will and testament of said deceased; that Louis J. Paul be, and he is hereby appointed Executor thereof. No bond required. -3- -10- continued. Together with other lands. (See note) Prays that said report be allowed and that the estate be distributed to the persons entitled thereto. Notice of Final Settlement was published in the Sheridan Press, before mentioned, four times, on Feb. 20, 27 and Mary 6 and 15, 1933• Proof of Publication filed March 15, 1933. Gives notice of the filing of final report, and that objections thereto may be'filed any time before March 25, 1933• March 27, 1933 given as date for making final settlement. Decree.of Final Settlement and Distribution entered April 10, 1933. The Court finds that the estate has been fully administered, that all claims including taxes and State and Federal inheritance taxes have been paid. Finds that Wilhelmina Demple died on Nov. 21, 1928, leaving as the only heirs entitled to share in the residue of the estate remaining for distribution to be George F. Demple and Oscar A. Demple, sons of the decedent, and sole beneficiaries as more fully appears and is particularly set out in the last will and testament of said Peter Demple, deceased. IT IS ORDERED, ADJUDGED AND DECREED that the said Final Account of George F. Demple and Oscar A. Demple, Executors, be allowed and approved, and that in pursuance of and according to the provisions of the last Will and Testament of said deceased the residue of said estate hereinafter particularly described, be, and the same is hereby, distributed share and share alike to George F. Demple and Oscar A. Demple, sons of decedent, in fee simple. The following is a particular description of said residue of the estate of which distribution is now ordered: Lots 1, 2, and 3 in Block 2 of Wood's Addition to the Town, now City, of Sheridan, Wyoming. Oscar A. Demple, Will of Oscar A. Demple. deceased. Dated Jan. 8, 1947. Filed Apr. 18, 1950. Book C of Wills, page 318. Testator first directs payment of all just debts. Bequeaths to his wife, Ethel M. Demple, all of his estate, real, personal and mixed, with provision that she may sell or dis- pose of any of said property without order of Court, but subject to confirmation by the Court. Appoints said Ethel M. Demple Executrix. Signed by Oscar A. Demple, in the presence of two witnesses. Petition for the probate of said Will was filed April 24, 1950. Petitioner, Harold F. Demple, alleges that Oscar A. Demple died on the 24th day of March, 1950; that he was a resident of Sheridan County, Wyoming at the time of his death and that he left estate therein consisting of real and personal property. That said deceased left a Will bearing date the 8th day of January, 1947, which petitioner alleges to be the last Will and testament of said deceased, and which is herewith presented. That the next of kin and heirs at law of said deceased are Ethel M. Demple, widow; Carl P. Demple, Harold F. Demple and Joseph A. Demple, sons, all of legal age. That said Ethel M. Demple has filed her appearance in this matter and has declined to serve as executrix and has requested the Court to appoint Harold F. Demple, petitioner herein, Adminis- trator with the Will annexed of the Estate of said deceased. Prays that said Will be admitted to probate and that Letters of Administration with the Will annexed be issued to petitioner. Waiver of her right to Letters Testamentary and request that Harold F. Demple be appointed Administrator with the Will annexed of the Estate of Oscar A. Demple, deceased, signed by Ethel M. Demple, was filed April 24, 1950. Notice of Time appointed for proving will was published in the Sheridan Press, before mentioned, four times, as follows: April 26, May 3, 10 and 17, 1950; Gives notice that May 18, 1950, at 10 o'clock a. m. at the Court Room of the District Court, Sheridan County, Wyoming, has been appointed as the time for proving the Will of Oscar A. Demple, deceased. Proof of Publication filed May 18, 1950. Will proved and admitted to probate May 18, 1950. The Court finds that the document heretofore filed, purporting to be the last Will and Testament of Oscar A. Demple, deceased, is the last will and testament of said deceased. That testator died on the 24th day of March, 1950; that he was a resident of and left estate in Sheridan County, Wyoming. IT IS ORDERED that the said document heretofore filed, pur- porting to be the last Will and Testament of said Oscar A. Demple, deceased, be admitted to probate as the last Will and Testament of said deceased; that Harold F. Demple, be, and he is hereby appointed Administrator with the Will annexed. Bond set at $30,000.00. Bond filed and approved and Letters of Administration with the Will annexed issued to Harold F. Demple May 18, 1950, and he qualified same date. Inventory and Appraisement filed July 26, 1950. Total of estate, $169,848.41. Petition for Distribution filed March 13, 1951. Petitioner, Harold F. Demple, Administrator with Will annexed, shows to the Court that under the terms of the Will of Oscar A. Demple, duly admitted to probate herein, Ethel M. Demple is the sole devisee and legatee of his estate; that notice to creditors has been duly published; that said Ethel M. Demple is desirous of having the estate of said testator vest absolutely in her as the sole legatee, and for ttis purpose is ready to furnish such bond as the Court may require. Prays that the Court set bond in such sum and with such sureties as it may require, conditioned that said Ethel M. Demple pay within such time as the Court may fix, all the debts of said testator filed or exhibited within the time fixed by the Notice to Creditors; that upon furnishing such bond this Court make further order and decree setting the estate of testator over and vesting it absolute in the said Ethel M. Demple as sole legatee, all as provided by Section 6- 307,W.C.S. 1945. Decree of Distribution entered March 13, 1951. The Court finds that Oscar A. Demple died on or about March 24, 1950. That he died testate and by the terms of his Will Ethel M. Demple was the sole devisee and legatee of his said estate. That said Will was duly admitted to Probate in Sheridan County, Wyoming. That -10- -41- continued. inventory and appraisement was filed herein and that Notice to Creditors was duly published and due proof of publication filed in this Court. That the said Ethel M. Demple is desirous of having the estate of said testator vest absolutely in her as the sole legatee; that for this purpose the said Ethel M. Demple has furnished bond with sufficient surety in the amount of $10,000.00 which bond is by the Court approved. That as shown by the Inventory and Appraisement of the pro- perty of said estate, a list of said property of the estate is hereto attached, marked Exhibit "A ", and by this reference specifi- cally made a part hereof. IT IS THEREFORE ORDERED AND ADJUDGED that a distribution of said Estate to Ethel M. Demple, be, and the same is hereby ordered, and the Administrator with the Will annexed of said estate is hereby authorized and empowered to distribute and deliver to the said Ethel M. Demple all of the property of said Estate set forth in Exhibit "A" attached hereto and by this reference specifically made a part hereof, and title to the same is hereby set over and transferred to the said Ethel M. Demple absolutely, together with all property of said estate which may be hereafter discovered. Attached to this Order, marked Exhibit "A ", is a list of real and personal property, together with the appraised value, including tYa following: A one fourth undivided interest in Lots 1, 2, and 3 in Block 2 of Wood's Addition to the Town, now City, of Sheridan, Wyoming. NOTE: The above estate includes the following: The South 370 feet of Lots 5 and 6, Block 1, of said Wood's Addition. -12 -- In the Matter In the District Court of of the Estate Sheridan County, Wyoming. of Probate No. 5597- Elizabeth Meyer, Petition filed May 5, 1954. Deceased. Petitioner, Louis J. Paul, alleges: That Elizabeth Meyer died on or about the 23rd day of April, 1954, in the County of Los Angeles, State of California. That said deceased at the time of her death was a resident of the said County of Los Angeles, and State of California. That said deceased left estate in the County of Sheridan, Wyoming consisting of real and personal property, including the following described real property, to -wit: An undivided one sixth interest in Lots 1, 2, and 3 of Block 2, Woods Addition. Together with other lands. (See Note) That the next of kin and heirs at law of said deceased are Louis Paul, brother, Melvin Paul, nephew, said Melvin Paul being the son of Frank Paul, brother of said deceased who predeceased said Elizabeth Meyer, all over the age of 21 years. Prays for a hearing on this application, and that upon said hearing Letters of Administration of said Estate be issued to your petitioner. Order appointing Administrator entered May 5, 1954. Held, his wife, a certain Mortgage Deed, which was duly recorded on June 4, 1897 in the office of the County Clerk and Ex- Officio Register of Deeds of Sheridan County, Wyoming, in Book "F" of Mortgages, at page 286, and in and by said Mortgage, did transfer and convey the following described Real Estate, situate in the County of Sheridan, State of Wyoming, to -wit: All of Block 3, except Lots 1, 2 and 11, of said Block; Block 4, except Railroad Right -of -Way; Block 6, except Railroad Right -of -Way; of Wood's Addition to the Town of Sheridan, Wyoming. Parcel 2: Lot 2, Block 3, Woods Addition to the Town, now City, of Sheridan, acquired from o'm. H. Hain to Richard E. Theisen and Velma E. Theisen, husband and wife, as an estate by the entireties with full right of survivor- ship. The date of said Deed is August 11, 1955, and was recorded on the same date in Book 103 of Deeds, Page 196 in the office of the County Clerk and Ex- Officio Register of Deeds for Sheridan County, Wyoming. Parcel 3: Lot 4, Block 2, Wood's Addition to the Town, now City, of Sheridan acquired from J. Riley Reynolds and Lula Reynolds to Richard E. Theisen and Velma E. Theisen, husband and wife, as an estate by the entirety with full right of survivorship on the 18th day of January, 1957. Said Deed was recorded in the office of the County Clerk and Ex- Officio Register of Deeds for Sheridan County, Wyoming, in Book 109 of Deeds, Page 43 on the 21st day of January, 1957. Parcel 4: Lot 5, Block 2, Woods Addition to the Town, now City, of Sheridan acquired from Charles W. Edmunds and Daisy Edmunds to Richard ".. Theisen and Velma E. Theisen, husband and wife, with right of survivorship and not as tenants in common. That said Deed was dated May 13, 1959, and was recorded in the office of the County Clerk and Ex- officio Register of Deeds for Sheridan County, Wyoming, in Book 121 of Deeds, Page 525 on June 10, 1959. That Affiant is the surviving spouse of the said Richard E. Theisen and is one and the same person who is named as a joint ten- ant or tenant by the entirety in all of the foregoing instruments; that title to said property now remains vested, by virtue of the death of the said Richard E.
