Proof of Publication filed Feb. 16, 1932. Inventory and.Appraisement filed Feb. 16, 1932. Final report and Petition for Distribution filed Dec. 21, 1932. Louis J. Paul, Executor of the last will and testament of George Paul, deceased, reports as follows: That George Paul, also known as Gotthard Paul, Gothard Paul, and G. Paul, died testate at Sheridan County, Wyoming, on the 10th day of Dec. 1931, and that the Will of deceased was admitted to probate and the said Louis J. Paul was appointed Executor thereof. That notice to creditors was published as required by law. That claims filed against said estate have been paid by the devisees. The Estate is now in condition to be finally settled and distributed in accordance with the Will of Deceased and the property available for distribution consists of money in the sum of $66.48 and the following described real estate: An undivided one half interest in Lots numbered 1, 2 and 3 in Block numbered 2 of Woods Addition to the City of Sheridan, Wyoming. Together with other lands. (See note) That, under the terms and provisions of said will, all of the property, real, personal and mixed of deceased was devised and bequeathed to Louis J. Paul, Elizabeth Meyer, and Mary Carr, in equal shares, so that the residue of said estate described above should be distributed to said named persons, one -third thereof to each. That all taxes levied against said property have been fully paid, except the inheritance tax. Prays for a hearing upon this report and account and.upon such hearing the same be allowed, approved and confirmed and that an Order of Distribution of the residue of said estate be made. Receipt of the Inheritance Tax Commissioner of the State of Wyoming filed Feb. 9, 1937, showing all inheritance taxes paid in full. Decree of Distribution entered Feb. 9, 1933• The matter coming on to be heard upon the final report and petition for dis- tribution filed herein by the Executor of the last will of George Paul, deceased, and due and legal notice of the time and place of hearing upon said final report and petition having been given as required by law, and no person appearing to contest or object to the same, and it appearing to the Court that notice of final settle- ment of said estate was published as required by law, that all taxes against said estate and all debts of deceased have been fully paid, and that said estate is now in condition for final settlement and distribution, and the Court further finds that the said George Paul has also been known as Gotthard Paul, Gothard Paul and G. Paul. IT IS THEREFORE, ORDERED, ADJUDGED AND DECREED by the Court that the residue of said estate of George Paul, deceased, hereinafter described and now remaining in the hands of the Executor and any other property which may belong to said estate or in which said estate may have any interest, be, and the same is hereby distributed as follows, to -wit: To Louis J. Paul, Elizabeth Meyer and Mary Carr, each the sum of $22.16 in money, and to said named persons each an undivided one third interest in and to the following described real estate, owned by deceased at the time of his death, to -wit: An undivided one half interest in Lots numbered 1, 2, and 3 in Block numbered 2 of Woods Addition to the City of Sheridan, Wyoming, together with other lands. IT IS FURTHER ORDERED, ADJUDGED AND DECREED by the Court that deceased left as his next of kin and only heirs at law the following named persons, all of whom are over the age of 21 years, to -wit: Elizabeth Meyer, a daughter, Louis J. Paul, a son, and Melvin Paul, a grandson. Notice of Final Settlement published in the Sheridan Press, before mentioned four times as follows: Nov. 29, Dec. 6, 13, 20, 1932. Mary Knodl, also known Probate No. 3074. as Mary Carr, deceased. Petitioner, Ludwig Knodl, alleges: That Mary Knodl, also known as Mary Carr, died on or about April 23, 1937, at the County of Sheridan, Wyoming; that she was a resident of said County, and that she left estate in said County. That the heirs at law of said deceased are Ludwig Knodl, husband, Sheridan, Wyoming; Melvin Paul, son, 1192 West 38th St., Los Angeles, California. That said deceased died intestate. Prays that Letters of Administration of the Estate issue to petitioner. Order appointing Administrator entered April 27, 1937. The Court finds that Mary K odl, also known as Mary Carr, died on the 22nd day of April, 1937, at Sheridan, Sheridan County, Wyoming; that she was a resident of said County; that she died intestate. ORDERED That Letters of Administration of the Estate of said Mary Knodl, also known as Mary Carr, deceased, issue to petitioner, Ludwig Knodl. Bond fixed at $1,500.00. Bond filed and approved and Letters of Administration issued to Ludwig Knodl and he qualified April 27, 1937. Inventory and Appraisement filed July 23, 1937• Notice to Creditors published in the Sheridan Press, a news- paper of general circulation, published at Sheridan, Sheridan County, Wyoming, 4 times as follows: May 5 -12 -19 -26, 1937. Proof of Pub- lication filed May 12, 1938. In the course of Administration there was filed by Melvin George Paul, son of deceased, his petition seeking the revocation -5- -8- continued. of Letters issued to Ludwig Knodl as Administrator of one Estate, alleging that said Ludwig Knodl and the deceased were not legally married, etc., but no order or decree or findings upon said peti- tion appear in the files. Petition for Distribution filed March 10, 1937, by Melvin George Paul, son of deceased, claiming negligence upon the part of Ludwig Knodl, Administrator, to file final report and make settle- ment. Final Account and Petition for Distribution filed May 12, 1938, by Ludwig Knodl, Administrator of the Estate. This report shows the estate as consisting of real estate, including an undivided one sixth interest in Lots numbered 1, 2 and 3 in Block number 2 of Woods Addition to the City of Sheridan, Sheridan County, Wyoming. Together with other lands, together with all improvements situate thereon or belonging thereto. (See Note) States that it will require the sum of $1,306.26 to pay the balance of costs of administration and claims against the estate and that your administrator who is the surviving husband of deceased and one of the heirs at law and Melvin George Paul, son of deceased, have entered into an agreement whereby the said Melvin George Paul has agreed to furnish to your administrator sufficient money to pay off all of said claims and expenses in consideration of your admin- istrator waiving all of his right, title and interest in and to said estate as the surviving husband of said deceased, and making and delivering a quit -claim deed to all of your administrator's right, title and interest in said real property and other estate,as survi- ving husband of said deceased, which deed has been delivered to the said Melvin George Paul. That by reason of said agreement your administrator hereby expressly waives all of his right to inherit from said deceased and consents that the residue of said estate be set over to the said Melvin George Paul as his sole and absolute real and personal property. Prays that this account be approved, and that a decree be made for the distribution of all the residue of the estate distributing all of said property to Melvin George Paul. Notice of Final Settlement published in the Sheridan Press, before mentioned, 4 times, as follows: April 21 -28, May 5 -12, 1g38. Proof of Publication filed May 12, 1938. Give; Notice of intention to file final report on or before May 13, 1938, and that objections may be filed any time before May 24, 1938, and that if no objections are filed the Administrator will make final settlement on May 25, 1938, or as soon thereafter as the matter may be heard. Supplemental Final Report filed June 6, 1938 showing full payment of all claims and obligations of the estate. Decree of Final Settlement and Distribution entered June 6, 1938. The Court finds that the only heirs at law of deceased are Ludwig Knodl, surviving husband, and Melvin George Paul, son. That the real estate owned by deceased consisted of an undivided one sixth interest in Lots numbered 1, 2, and 3 in Block number 2 of Woods Addition to the City of Sheridan, Sheridan County, Wyoming, together with all improvements situate thereon or belonging thereto. Together with other lands. (See Note) That Ludwig Knodl, surviving husband of said deceased, has made, executed and delivered to Melvin George Paul a quit -claim deed to all of his right, title and interest in the real property herein - beforec3escribed and owned by the deceased, etc. Finds that there are no debts or obligations now existing against the estate. IT IS THEREFORE HEREBY ORDERED, ADJUDGED AND DECREED, that the final report and account and the supplemental final report and account and petition for distribution of Ludwig Knodl as Administrator be and the same are hereby in all respects approved and confirmed. That title to all of the above described real estate be and the same is hereby vested, decreed and confirmed in the said Melvin George Paul, son of said deceased, by reason of the quit- claim deed made, executed and delivered by the said Ludwig Knodl, surviving husband of said deceased, to all of his right, title and interest in and to said real property and in conformity with the agreements entered into between the said Ludwig Knodl and the said Melvin George Paul. Further decrees the personal property remaining to said Melvin George Paul. Estate closed and Administrator discharged. NOTE. Report shows estate fully administered, all debts, expenses and the State and Federal Inheritance Taxes paid. That Wilhelmina Demple, wife of the said Peter Demple, died Nov. 21, 1928. That George F. Demple and Oscar A. Demple are each entitled to one -half of the residue of the estate under the terms of the Will of said deceased. Paul, Administrator of the Estate of Elizabeth Meyer, deceased represents to the court as follows: That notice to creditors was published as required by law; that all claims have been fully paid; that the time within which claims could be filed has terminated. That inventory and appraisement was filed as required by law; Administrator gives a full report of moneys received and expended during the period of the administration of the estate. That so far as known the residue of said estate consists of the following, to -wit: Real Property: Parcel 4. An undivided one -sixth interest in and to the following described lands, to -wit: Lots 1, 2, and 3 of Block 2, Wood's Addition. Together with other lands. (See Note) That all just claims, and expenses, including funeral expenses and expenses of last illness, court costs and attorney fees, have been fully paid, and that all expenses of administration have been paid; that a report has been filed with the Inheritance Tax Commis- sioner of the State of Wyoming and that said Commissioner has issued his certificate and receipt showing all inheritance taxes paid. That Elizabeth Meyer died intestate in Los Angeles County, California on April 23, 1954; that at the time of her death she was a resident of Sheridan County, Wyoming and that she left surviving her as her only heirs at law and next of kin, her brother, Louis J. Paul, age 68, and her nephew Melvin Paul, also known as Melvin George Paul, about 46 years of age. Prays for a hearing on this final account and petition for distribution and upon such hearing the same be settled, allowed, approved and confirmed; that an order be made and entered herein distributing the property remaining in the hands of the administra- tor to the person or persons entitled thereto. Redle, Attorney for the Estate filed Sept. 12, 1955, in which he alleges that immediately after the first publication of Notice, this affiant caused copies of said notice of final settlement, together with copies of the final account and -12- -12- continued. petition for distribution to be mailed to Melvin Paul, also known as Melvin George Paul, nephew of said deceased, and that he also caused a copy of said Notice of Final Settlement and copy of said Final Account and petition for distribution to be personally de- livered to Louis J. Paul, brother of said deceased; that said persons are the only heirs at law and next of kin of said deceased. Decree of Distribution entered Sept. 12, 1955. The Admin- istrator of the Estate proves to the satisfaction of this Court that his final account and petition for distribution was filed herein on Aug. 31, 1955 as required by law, and that Notice of Final Settlement of said Estate has been duly published as required by law, and it appearing that all taxes upon the property of said estate have been fully paid, that all charges and expenses of admin- istration have been fully paid and that no claims which have been filed against said estate or with said Administrator are unpaid, and that the time within which to file claims has expired.
