Contract Amendment No. 01 to AIA Document A133 — 2009 Standard Form of Agreement between Owner and
Construction Manager as Constructor between the Sheridan Economic & Education Development Authority and
Dick Anderson Construction, Inc.
Sheridan Economic & Education Development Authority (Owner) and DICK ANDERSON CONSTRUCTION,
INC. (CM), for the WEATHERBY HEADQUARTERS & MANUFACTURING FACILITY (the Project), the Owner and
CM establish the following terms for commencement of the Construction Phase prior to completion of the Pre -
Construction Phase in absence of the Guaranteed Maximum Price (GMP) Proposal for the entire project as set forth
below.
Owner authorizes Dick Anderson Construction, Inc. to commence the Construction Phase of the Project prior to
completion of the Pre -Construction Phase. Owner and Dick Anderson Construction, Inc. agree to proceed with
Construction Phase work in absence of a GMP for the entire project until such time the GMP can be established.
Both parties agree that the GMP Proposal for the entire project shall be submitted for Owner approval following
receipt of Bid Phase 3 subcontractor bid proposals, anticipated to be received on April 12, 2018. Furthermore
Owner and Dick Anderson Construction, Inc. agree as follows:
• Owner authorizes Dick Anderson Construction, Inc. to proceed with Bid Phase One work inclusive of Bid
Package 13A — Pre -Engineered Metal Building Supply and Erection and all associated General
Requirements; Permits, Fees, Bonds and Insurance on or about March 21, 2018.

The CM's Guaranteed Maximum Price for the Work is TWO MILLION ONE HUNDRED THIRTY SEVEN THOUSAND
SIX HUNDRED NINETY NINE DOLLARS AND ZERO CENTS. This Price is for the performance of the Work in
accordance with the Contract Documents listed and attached to this Proposal and marked Exhibits A through D, as
follows:

ASSUMPTIONS AND CLARIFICATIONS
The GMP Proposal assumes and relies upon the following modifications to the Bidding Documents as agreed
between Owner, Design Team and CM:
1) This Proposal assumes Alternate No. 01 — Reduction of one bay of Manufacturing has been accepted by
the Owner.
2) The GMP assumes that two (2) 60'x 60' clerestories will be omitted from the scope of the project.
3) The GMP provides for enlarging the center clerestory to a footprint of 60' x 90'.
4) This Proposal assumes that sno-bar retention systems will not be required on the enlarged, center
clerestory roof.
5) This Proposal assumes that three (3) small gable roof overbuilds located along Grid -Line `D' on the north
side of the manufacturing building roof will be eliminated from the scope of Bid Package 13A — Pre -
Engineered Metal Building Supply and Erection.
6) We have provided for supply and installation of Utility Saver, primary wall and roof insulation systems
manufactured by Thermal Designs, Inc. in lieu of the basis -of design Simple Saver system.
7) This Proposal provides for supply and installation of pre-engineered metal building manufacturer's (B&C
Steel) standard 26 -gauge (colored) 'PBR' wall and soffit panels on entire building in lieu of Basis -of -
Design Metal Sales 24 -gauge, IC72 wall and soffit panels.
8) The GMP provides for pre-engineered metal building manufacturer (B&C Steel) standard mezzanine
design for Office mezzanine. B&C Steel's standard mezzanine design for specified 50 psf LL, 15 psf
partition load, 60 psf DL (as designed by B&C's registered engineer) has been provided. Please note that
special floor vibration requirements for the Office mezzanine outlined in Specification Section 133419.13,
Section 1.6 — Structural Requirements, Item 4. Floor Vibration Requirements is specifically excluded from
this Proposal.
The GMP provides for supply and installation of pre-engineered metal building manufacturer's (B&C Steel)
standard metal trims for finish out of exterior openings. Please note that supply and installation of a 6" tall x 2"
deep break metal trim around all exterior openings is specifically excluded from this Proposal.
The GMP excludes Quality Control Testing, it is our understanding that Owner will pay for all Quality Control
Testing outside of this contract.
The GMP excludes any and all costs associated with winter protection, temporary enclosures and/or temporary
heating. It is assumed these costs will be accounted for in subsequent Contract Amendments.
